Here are some answers to the questions that come up most often.

Our records identified you as a potential beneficiary/heir of the estate referenced in the letter. As such, we are interested in making you a cash offer in exchange for your interest.

Excellent question! Assuming you are a legal heir/beneficiary and are interested in selling your interest, everything will be put in writing and signed by all parties in compliance with Florida Law.

Although the data used to locate potential relatives is fairly accurate, it is not fool-proof. Sometimes this results in letters sent to people who are completely unrelated. If that happened to you, please feel free to disregard this letter and accept our apologies.

In a perfect word, everyone would agree to sell their interest. That doesn’t always happen. We are well aware of this. Based on past experience, once one beneficiary sells his/her interest, the others naturally follow. We assume the risk of that not happening. This will not impact any potential deal you negotiate with us.

Absolutely nothing! We will pay all legal costs/expenses to probate the estate (if there is no probate). You will have no liability whatsoever. This is clearly spelled out in the contract.  

Not at all! We will pay all costs incurred in probating the estate. We have a network of attorneys that we work with for these types of matters.

If you have a specific attorney you wish to use, that is perfectly fine. We will pay that attorney the reasonable fees/costs in probating the estate. The only caveat being that attorney must be licensed in the State of Florida and in good standing with the Florida Bar.

There are a multitude of factors that are taken into consideration. For one, whether or not you are a lawful heir/beneficiary and if so, how much of an interest you have. By way of example, suppose you have two (2) other siblings in addition to yourself. You would only be entitled to 1/3rd. As such, your offer will reflect that.

Other factors are the condition of the property, the amount of liens (i.e. mortgages, association dues, delinquent taxes, etc.…) and comparable sales data.

We pay you a small percentage upfront upon the signing of the initial documents. This is done as a showing of good faith. The remainder is paid upon successful completion of probating the estate or once the title is transferred (if there has already been a probate). Depending on the circumstances, this may take up to 2-3 months.  

Not at all! Everything can be done online. In most states (including Florida), documents can be electronically notarized online. We will pay all electronic notary fees.
